Supreme Court to Rule on Expanding Miranda Globally

WASHINGTON (AP) - The Supreme Court will decide whether a suspect has to be told that he has a right to have a lawyer present during questioning by police.

The court on Monday agreed to hear an appeal from Kevin Dwayne Powell, who was convicted of being a felon in possession of a firearm.

When he was arrested, police gave Powell his Miranda warnings, including telling him he had a right to a lawyer before questioning. Powell's lawyers objected, saying police did not tell him he had a right to have a lawyer during his police interrogation.

The Florida Supreme Court overturned the conviction, saying the police's Miranda warning was insufficient.

WASHINGTON (AP) - American troops made substantial errors and did not strictly follow rules for avoiding casualties during an air assault on Taliban fighters last month, a U.S. defense official said, underscoring a central quandary for President Barack Obama's new Afghan counterinsurgency campaign.

The defense official said Wednesday that a military investigation faulted some of the actions of American troops in air strikes May 4 that killed dozens of Afghan civilians in Farah province.

"Errors were made" in the attack, the official acknowledged on condition of anonymity, discussing one of the preliminary findings on an incident that has strained relations between Washington and Kabul and bred deep resentment among the Afghan people. Civilian deaths in Afghanistan have also enraged Muslims worldwide.

Though the probe looked into the events in early May, commanders for well over a year have focused considerable attention on the problem. It looms as large as ever as the Obama administration streams 21,000 troops into Afghanistan to try to regain momentum in the faltering war.

The new U.S. commander in eastern Afghanistan was asked about the issue at a news conference on his first day Wednesday, when he only took two questions. Maj. Gen. Curtis Scaparrotti, commander of the 82nd Airborne Division, responded that he planned to use close air support for troops only when needed to protect them and to complete the mission. And he said air strikes would be used carefully.

The nominee for top commander in Afghanistan was asked about it at his confirmation hearing Tuesday on Capitol Hill. Lt. Gen. Stanley McChrystal told senators: "This is a critical point. It may be the critical point. This is a struggle for the support of the Afghan people."

A report Wednesday by analysts at the think tank Center for a New American Security said that in order to turn around the Afghanistan/Pakistan problem, the United States must "rapidly triage" its priorities. "Protecting the population must take precedence over all other considerations," the report said.

McChrystal said that if confirmed, he will review all existing rules of engagement and all tactical directives. But American military commanders on a number of occasions already have reviewed and rewritten the rules - including those on bombing missions and on how special forces operate - in an effort to avoid Afghan casualties.

Rules tightened in a review last year may not have been followed by troops on May 4, said the official who spoke about the investigation.

One example cited by the investigators, the official said, involved a U.S. warplane that got permission to launch an attack against a suspected Taliban site. For some reason, the plane circled back and didn't reconfirm the target before dropping the bomb. The official said that left the possibility that civilians had entered the area or that the Taliban had left in the interim.

Officials have insisted they go to great lengths to avoid civilian casualties.

Maj. Gen. William Rew, the Air Force's director of operational planning, policy and strategy, said during a meeting with reporters earlier this year that "thousands" of attacks have been called off at the last minute when live video feeds from unmanned aerial vehicles showed civilians in the area of a planned strike.

Afghans say 140 civilians died on May 4, while American commanders say video evidence recorded by fighter jets and the account of the ground commander suggest no more than 30 civilians were killed, as well as 60 to 65 Taliban.

The International Committee of the Red Cross said a team that it sent to the area saw "dozens of bodies in each of the two locations," including women and children.

In Geneva, U.N. human rights investigator Philip Alston said Wednesday that about two-thirds of those killed appeared to be civilians, citing studies by the United Nations, the Afghan Independent Human Rights Commission and other monitors. He said he expected more information to come out in the coming days, and said U.S. reports "have become more and more detailed."

Said Alston: "The most important point is simply that there's no disagreement that a very significant number of civilians were killed."

According to the U.S. military, the battle in Farah began a day after Taliban fighters entered two villages, demanded money from civilians and killed three former government employees. An Afghan force rushed in, only to be ambushed by as many as 300 insurgents.

The provincial governor asked for U.S. military help, and American ground troops joined the battle, the U.S. says.

Before the battle was over, troops called in F-18 fighter jet airstrikes as well as help from a B-1 bomber, coordinating with the ground commander to strike a half-dozen targets including buildings and a tree grove insurgents were firing from or massing in, the U.S. has said.

June 18, 2009 even with the ‘less-then-great liberator’ as president, those of us in America take freedom, democracy and liberty for granted. it has been our birthright since the beginning of our country. for iran, totalitarianism by the supreme leader and mullahs, have ruled for so long that when it’s core foundation is shaken like this, it’s remarkable.

it’s amazing how long totalitarians can actually stay in power isn’t it? look at nk and the kim dictator dynasty. this is especially curious to me given the

cry for freedom that is so completely in human dna.

the father of modern political theory, niccolo machiavelli, once said that every form of government ultimately rests on the consent of the governed. is that ever so true! (definately for an obama post on another day! heh.)

the supreme leader (and the mullahs) in iran have maintained control with a tight fist, but that strategy depended on dividing and conquering. iran is quite knowledgeable how to use real torture, kidnappings and disappearances, horrible brutality and bloodshed, and of course those massive public hangings to silent dissent from it’s people. surely these ‘where is my vote?’ protests will end with public hangings — but for whom? after all the challenger, mousavi, is just as hardline in many ways as the completely certifiable ahmadinejad.

and really, in looking at the amazing photos coming out of iran on an hourly basis, what can the mullahs do to maintain its totalitarian grip on power, when the protestors now number not in the hundreds, but in the hundreds of thousands - even millions?

Obama directly addresses the Iranian government for the first time after a day of violence in Iran: The Iranian government must understand that the world is watching. We mourn each and every innocent life that is lost. We call on the Iranian government to stop all violent and unjust actions against its own people. The universal rights to assembly and free speech must be respected, and the United States stands with all who seek to exercise those rights.
As I said in Cairo, suppressing ideas never succeeds in making them go away. The Iranian people will ultimately judge the actions of their own government. If the Iranian government seeks the respect of the international community, it must respect the dignity of its own people and govern through consent, not coercion.
Martin Luther King once said - “The arc of the moral universe is long, but it bends toward justice.” I believe that. The international community believes that. And right now, we are bearing witness to the Iranian peoples’ belief in that truth, and we will continue to bear witness.

History & Development: United Nations Security Council Resolution 1373 is a counter-terrorism measure adopted September 28, 2001, following the September 11 terrorist attacks on the United States.

The resolution was adopted by a unanimous UN Security Council under Chapter VII of the United Nations Charter, and is therefore binding on all UN member states.

It marks a shift in international law, as the latter was presumed to be valid only if the concerned state had voluntarily signed the international treaty; whereas here the Security Council imposed the resolution on all member states.

According to the press release, the "meeting, which began at 10:50 p.m., adjourned at 10:53 p.m." and thus lasted three minutes. There is no record of the meeting, and although the United States is widely credited with initiating Resolution 1373, it is not known who really was responsible for its passage.

Purpose: The resolution aimed to place barriers on the movement, organization and fund-raising activities of terrorist groups. UN member states were encouraged to share their intelligence on terrorist groups in order to assist in combating international terrorism. The resolution also calls on all states to adjust their national laws so that they can ratify all of the existing international conventions on terrorism. It stated that all States "should also ensure that terrorist acts are established as serious criminal offences in domestic laws and regulations and that the seriousness of such acts is duly reflected in sentences served."

It also aimed at restricting immigration law, stating that "before granting refugee status, all States should take appropriate measures to ensure that the asylum seekers had not planned, facilitated or participated in terrorist acts. Further, States should ensure that refugee status was not abused by the perpetrators, organizers or facilitators of terrorist acts, and that claims of political motivation were not recognized as grounds for refusing requests for the extradition of alleged terrorists."

Problems: However, the resolution failed to define 'Terrorism', and the working group initially only added Al-Qaida and the Taliban regime of Afghanistan on the sanctions list. This also entailed the possibility that authoritarian regimes could label even non-violent activities as terrorist acts, and thus infringing upon basic human rights.

2003 Improvement: Resolution 1456 (2003) The absence of any specific reference to human rights considerations was remedied in part by Resolution 1456 (2003) which declared that "States must ensure that any measure taken to combat terrorism comply with all their obligations under international law, and should adopt such measures in accordance with international law, in particular, international human rights, refugee, and humanitarian law."

Resolution 1566 adopted on 8 October 2004 : UN Security Council Resolution 1566 picked up loose ends from 1373 by actually spelling out what the Security Council sees as terrorism:

"criminal acts, including against civilians, committed with the intent to cause death or serious bodily injury, or taking of hostages, with the purpose to provoke a state of terror in the general public or in a group of persons or particular persons, intimidate a population or compel a government or an international organization to do or to abstain from doing any act."

Although this definition has operative effect for the purposes of Security Council action, it does not represent a definition of "terrorism" which binds all states in international law. That is a task which could only be achieved by way of agreeing to an international treaty under the auspices of the UN General Assembly. Negotiations towards agreeing to such are ongoing, and a Comprehensive Convention exists in draft form, however agreement to its exact terms, most particularly the definition of "terrorism", remains elusive.

Resolution 1566 also called for the creation of a working group that will expand the list of terrorist entities under sanction beyond the Taliban and Al-Qaida.

Recommendations of the Counter Terrorism Committee 2008 report included increased measures concerning illegal immigration (considered, without evidence, as a serious risk to security) as well as:

to "Promote inter-agency coordination and the exchange of counter-terrorism information at the national, regional and international levels";

to "Encourage States to establish dedicated and permanent counter-terrorism units, with the assistance of experts seconded from various specialized institutions, in areas such as criminal law, counter-financing of terrorism and border control";

to "Encourage greater cooperation with INTERPOL and increased utilization of its resources and databases, such as red notices and watch lists" (Interpol created in 2002 the Interpol Terrorism Watch List).

The Counter-Terrorism Committee (CTC) and its Executive Directorate (CTED) are actively engaged in developing closer ties with international, regional and subregional organizations , which play an important role in assisting States with the implementation of resolution 1373 (2001).

The Security Council decides that States shall prevent and punish the financing, planning, preparation or perpetration of terrorist acts. The resolution covers, inter alia, suppression of the recruitment of terrorists; provision of early warning and information sharing; prevention of the movement of terrorists and of trafficking in arms, explosives and hazardous materials; border controls; becoming a party to the international counter-terrorism instruments; bringing terrorists to justice; and Member States’ obligations under international law, in particular international human rights and humanitarian law when addressing refugee issues.

The Vienna-based United Nations Office on Drugs and Crime (UNODC), for example, provides countries with assistance on counter-terrorism legislation; the United Nations Development Programme (UNDP) addresses developmental and governance issues in a broad context of counter-terrorism work; the International Atomic Energy Agency (IAEA) focuses on nuclear terrorism and the World Health Organization (WHO) on bio-terrorism.

UN global counter-terrorism strategy: A year later on 8 September 2006, the General Assembly adopted resolution A/RES/60/288 to create a Global Counter-Terrorism Strategy, marking the first time that all Member States have agreed to a common strategic and operational approach to fighting terrorism.

The working group’s main objectives are to enhance expertise and develop common approaches by CTED staff on these issues, as well as to consider ways in which the Committee might more effectively encourage Member States to comply with their international obligations in this area.

GPS Satellite Glitches Fuel Concern on Next Generation

Technical problems are degrading the accuracy of signals from the last GPS satellite launched by the Pentagon, sparking concerns among U.S. military and aerospace industry officials that the next generation of the widely used satellites could face similar troubles.

The Air Force's Southern California space acquisition center on Tuesday announced that a Global Positioning System satellite, manufactured by Lockheed Martin Corp. and launched in March, is experiencing performance problems in orbit. It hasn't become part of the "operational constellation" of more than two dozen other GPS satellites, and is slated to undergo a battery of tests expected to stretch through October to try to resolve the problems, according to an Air Force news release.

The GPS system, which serves both military and civilian users, provides precise time and location coordinates for everything from military missile launches and "smart" bombs to automated bank-teller machines to aircraft, ships and everyday vehicles. The Lockheed satellite is the first to include a new civilian frequency -- dubbed L5 -- designed for, among other things, use by future nationwide air-traffic control systems. But that signal, part of test package, apparently is interfering with other signals from the satellite and reducing their accuracy, according to industry and Air Force officials. The degraded signals are accurate only to about 20 feet, versus about two feet for typical GPS signals, industry officials said.

While the Air Force said it has "high confidence there is no related concern" with other Lockheed satellites in orbit or waiting for launch, Air Force brass have begun examining whether Boeing versions of GPS satellites require additional tests and analysis to eliminate concerns, according to industry officials familiar with the details. A spokeswoman for Boeing declined to comment. A Lockheed Martin spokesman said the company is working with the Air Force "to fully evaluate the issue and to ensure the satellite meets GPS requirements."

In its release, the Air Force said the routine in-orbit checkout of the suspect Lockheed satellite revealed that some signals "were inconsistent" with comparable GPS satellites. The Air Force also said upcoming tests will include simulations and "testing of real-life GPS receiver equipment to the greatest extent possible" to prevent "inadvertent impacts to GPS users."

The first of Boeing's GPS IIF satellites, incorporating the new civilian signal, is slated to launch late this year or early 2010, delayed from the summer.

In May 2008, Lockheed bested Boeing to win a contract worth at least $1.8 billion to build the most-advanced navigation satellites yet, dubbed GPS III, scheduled to go into operation around the middle of the next decade.

Concerns over signal quality come barely weeks after a Congressionally-ordered study raised a red flag about potential erosion of GPS accuracy in the next few years due to launch delays and other challenges. If certain launches get delayed up to two years, the General Accountability Office report predicted, the Pentagon could have trouble maintaining the desired fleet of 24 fully-functional GPS satellites in operation.

The Pentagon responded by minimizing the potential risk, arguing that significant spare capacity remains on orbit and on the ground to handle unexpected problems. Gen. Robert Kehler, head of Air Force Space Command, said in an interview earlier this month that the GAO conclusions were overly pessimistic partly because they failed to take into account strategies the Air Force could use to extend the life of existing satellites. For example, Gen Kehler said, managing power output could give solar arrays longer life.

Despite some continuing quality-control issues with Boeing's IIF versions, Gen. Kehler said, "we're not going to have an issue" maintaining the current robust constellation.

Gunman, guards exchange fire in Holocaust Museum

WASHINGTON – 

A gunman exchanged fire with security guards inside the U.S. Holocaust Memorial Museum on Wednesday.

U.S. Park Police Sgt. David Schlosser said the gunman walked into the museum with what he described as a "long gun." 

The gunman and a security guard were shot. 

Both were taken to the hospital, but the extent of their injuries wasn't immediately known.



U.S. Park Police initially gave slightly different information, saying three people had been shot. 


Fire department spokesman Alan Etter told CNN a third person was hurt after being cut by broken glass. 


Several witnesses said they saw the security guard on the floor and bleeding.

The museum normally has a heavy security presence with guards positioned both inside and outside. All visitors are required to pass through metal detectors at the entrance, and bags are screened.

Schlosser said park police SWAT teams were doing a secondary sweep of the building, but they didn't believe there was another gunman.

The museum, located just off the National Mall near the Washington Monument, is a popular tourist attraction. It draws about 1.7 million visitors each year.

Roads surrounding the museum have been closed and blocked off with yellow tape. Several police cars and officers on horses surround the area.

Mark Lippert of Lasalle, Ill., said he was at the museum when he heard several loud pops and saw several schoolchildren running toward him, three with horrified looks on their faces.

He said when he saw the kid's faces, he knew someone had been shot.

Sandy Perkins of Massachusetts said her daughter, Abigail, called her shortly after the shooting. The teen was on a school trip to the museum and told her mother students heard several shots before they were told to leave the building.

Abigail said some of her friends from Holton Richmond Middle School in Danvers, Mass., were very shaken, but all were otherwise fine, Sandy Perkins said.

The teens did not see where the shots were coming from.

Linda Elston, who is visiting the museum from Nevada City, Calif., said she was on the lower level of the museum watching a film when she and others were told to evacuate.

"It was totally full of people," Elston said. "It took us a while to get out."

She said she didn't hear any shots and didn't immediately know why there was an evacuation. The experience left her feeling "a little anxious," she said.

Police confirmed the name of suspect as James W. Von Brunn, The Washington Post reported. Officials said the man -- if he is the James W. Von Brunn they suspect -- has connections to U.S. hate and anti-government groups, several media .

the suspected murderer of private long is domestic terrorist abdulhakim mujahid muhammad, formerly known as carlos bledsoe. we know now he was radicalized after converting to islam and even traveled for ‘training’ to yemen. evidence is still unfolding but this attack seems to be linked to more people and be bigger in scope.

of course, it took obama only a couple of hours to release a statement on the murder of abortionist tiller. do me a favor and contrast the statements.

update: pfc. long’s funeral is today. arkansas flags will be flown at half-staff. he will be buried at the arkansas state veterans cemetery. please pray for his family - it’s a tough time for them. and don’t forget to continue to pray for the recovery of pfc. quinton ezeagwula.

when he had a so-called slip of the tongue with George Stephanopolis saying ‘my muslim faith’ it was just a mistake (though how a born again christian does that i am not certain). and, of course, we couldn’t even use his middle name of ‘hussein’ without being excoriated and called racist by the great unhinged.
he and his campaign lemmings did everything they could to emphasize his christianity and de-emphasize the fact that his father was born muslim.

getting through this upcoming foreign tour may be difficult for me. his endless pandering seems to have no bounds. his apologies to the world? no mas! and his total lack of character and integrity is astonishing to me.

this newly stage crafted ‘muslim and proud of it’ obama deserves to be seriously mocked and roundly ridiculed.

The Five Pillars of Islam

The five pillars of faith are observances in Islam which are duties each Muslim must perform.

  1. Creed (Kalima)- One must state, "There is no God but Allah, and Muhammad is the Prophet of Allah." publicly to become a Muslim.
  2. Prayer (Salat)- Prayer must be done five times a day (upon rising, at noon, in mid-afternoon, after sunset, and before going to sleep) towards the direction of Mecca. The call to prayer is sounded by the muezzin (Muslim crier) from a tower (minaret) within the mosque.
  3. Almsgiving (Zakat)- Muslims are legally required to give one-fortieth of their income to the needy. Since those whom alms are given are helping the giver achieve salvation, there is no sense of shame in receiving charity.
  4. Fasting (Ramadan)- During the holy month of Ramadan, faithful Muslims fast from sunup to sundown each day. This develops self-control, devotion to God, and identity with the needy.
  5. Pilgrimage (Hajj)- Each Muslim is expected to make the pilgrimage to Mecca at least once in their lifetime if they have the means to do it and are physically capable of the trip. It is an essential part of gaining salvation, so the old or infirm may send someone in their place. It involves a set of rituals and ceremonies.

obama gave a 6,000 word speech today in cairo in which he continued to lay blame on america and pander to the muslim world. some have described his cairo speech as ‘history making’ as is everything he does. others, like myself, think it was more anti-american apologism and basically a big yawn.

obama’s full text of his cairo speech is here so you can go read it yourself. but i would like to highlight a couple of passages that popped out at me as completely laughable if not outrageously false.

“I have come here to seek a new beginning between the United States and Muslims around the world; one based upon mutual interest and mutual respect; and one based upon the truth that America and Islam are not exclusive, and need not be in competition. Instead, they overlap, and share common principles — principles of justice and progress; tolerance and the dignity of all human beings.”

um, excuse me? tolerance and dignity of all human beings except for WOMEN! what tolerance has the muslim world shown women who are made to cover their faces/hair and wear burkas? what tolerance does saudi arabia show women who are not allowed to make eye contact or drive cars? what tolerance did afghanistan show when flogging a teenage girl recently and enacting a law that allows for rape in marriage? what tolerance was shown by the saudis who tried to enforce a little girl to marry a man over 50 years old? even the lefties are scratching their heads over that one.

placing western culture on an even footing with arab cultures yet omitting the inconvenient truths that women are subjugated in those cultures, gays ostracized or killed outright, freedom of the press rare, and elections usually farcical is really an affront to democracy especially when its said by the leader of the free world for gosh sakes!

and then there was this:

“Over seven years ago, the United States pursued al Qaeda and the Taliban with broad international support. We did not go by choice, we went because of necessity. I am aware that some question or justify the events of 9/11. But let us be clear: al Qaeda killed nearly 3,000 people on that day. The victims were innocent men, women and children from America and many other nations who had done nothing to harm anybody. And yet Al Qaeda chose to ruthlessly murder these people, claimed credit for the attack, and even now states their determination to kill on a massive scale.”

fair enough. so why muck it all up by excusing it away and apologizing by saying this?'

“And finally, just as America can never tolerate violence by extremists, we must never alter our principles. 9/11 was an enormous trauma to our country. The fear and anger that it provoked was understandable, but in some cases, it led us to act contrary to our ideals. We are taking concrete actions to change course. I have unequivocally prohibited the use of torture by the United States, and I have ordered the prison at Guantanamo Bay closed by early next year.”

what the heck is he talking about???? lumping 9/11 with gitmo, waterboarding, torture??? more ‘dump on bush’ and side with muslims in saying they are justified in their anger against us. is this what we want him saying on our behalf?

a foreign policy based on appeasement never works. whether the obama administration admits it or not, doesn’t change the fact that there is still a war on terror and language like this sends the wrong message to our enemies. terrorists don’t parse or practice nuances. they cut off heads. they use planes as missiles. they use disabled children and widows as human bombs for ‘the cause’.

why The One refuses to acknowledge and confront the violent jihadi virus around the world and here on american soil is beyond me. invoking his Muslim roots, groveling to unelected despots, even inviting terrorists themselves to the speech seems to be an indication of the over inflated ego, confidence of The One to talk his way out of anything — even terrorism.
